Three New Template Agreements Now Available in the Chamber’s E-shop
- Template for the Agreement for the Compensation of Training Costs
The agreement for the compensation of training costs allows the employer and the employee to agree that the employer makes additional costs for training the employee as compared to the reasonable costs made for training the employee and the employee continues to work with the employer to compensate these costs during the agreed period (binding period).
Should the employee terminate the employment contract before the binding period is over, the employee is obliged to compensate to the employer the additional costs proportionally calculated considering the time left until the end of the binding period. As an exception, an employee is not required to compensate the costs if the reason for the termination of the employment contract is the employer’s significant violation of the employment contract.
The Employment Contracts Act foresees various conditions that have to be met for the agreement to be valid. For example, the agreement must be signed by the parties, the agreement should indicate the content and costs of the training, the binding period should not exceed three years and the binding period may not be unreasonably long considering the training costs.
The lawyers of the Chamber have drawn up the template for the agreement for the compensation of training costs, which complies with the terms and conditions set out in the Employment Contracts Act. The template is free of charge for the members of the Chamber and for non-members the template costs €15, value added tax not included.
Should you have any questions regarding the template, please contact the lawyers of the Chamber by writing to juristid@koda.ee.

- Template for the Application for the Termination of the Employment Contract
The template for the application for the termination of the employment contract allows employers exceptional termination of employment contracts for good reason as set out in the Employment Contracts Act due to which continuation of the employment relation cannot be continued in the interests of the employer and the employee.
For example, employers have the right to terminate the employment contract if the employee has failed to perform their duties for a long time due to their health, which does not allow continuing the employment relation (decreased ability to work due to health), despite warnings, the employee has ignored the reasonable orders of the employer or violated their duties, or the employee has committed a theft, fraud or any other action that caused the loss of trust of the employer.
