Termination of the employment contract by agreement of the parties

According to § 79 of the Employment Contracts Act (hereinafter referred to as the "Employment Contracts Act"), the parties may terminate both fixed-term and open-ended employment contracts at any time by agreement. Based on the principle of freedom of contract, the TLS does not impose any further obstacles or conditions for the termination of an employment contract if the parties have agreed to it. It is important that both parties agree to the termination of the contract and that they agree on the terms of the termination by agreement (e.g. the date of termination, the payment of any benefits, etc.).

The basic termination by agreement of the parties is suitable for situations where the employer and the employee wish to terminate the employment contract by agreement.
